Florida man fights against speeding ticket and wins, part 2
Our last post left off beginning to outline the argument of a Florida defendant who challenged his traffic ticket in court based on aspects of the Florida State and United States Constitution.
In the Florida defendant's case and the general case of red light camera tickets, the defendants are those who have to fight to prove that the assumption that they are guilty is wrong. They are even expected to provide the physical evidence that the prosecution would normally be expected to collect regarding the charge. The defendant argued that this expectation goes against what's generally accepted within the criminal justice process.
